The Site and Mobile Application works with Employers, Client Partners or other Affiliated Partners, as well as certain other third parties described herein, to create an incentive program that rewards your healthy eating habits, either through direct reimbursement or coupons and discounts on products you have a history of purchasing (the “Services”).
1. Information Collection
1.1 Information Provided by Employers, Client Partners or Other Affiliated Partners
1.2 Information Provided by You
1.2.1 We also collect and store information that you voluntarily provide to us as well as data related to your Site visit or Mobile Application usage. You can use the Services to set up a user profile that will help you track and reinforce healthy eating habits. In establishing your user profile, you can choose to provide us with additional data, including your age, gender, household income, race, ethnicity, family size, email address, home address, bank account information (if you opt to have the rewards that you earn as a part of our rewards program deposited directly in your bank account) and the account or card number associated with certain retailer loyalty programs or the user-name and password that you use to access retailer website and internet services (your “User Profile Information”). You also have the option to provide us with certain medical information, including identifying any allergies or medical conditions (your “Medical Information”). Certain functions of the Site and Mobile Application allow you to upload, submit, disclose, or offer certain original materials, such as recipes, reviews, photographs, images, videos, comments, feedback, postcards, suggestions, ideas, notes, drawings, concepts, and other information, content or material (your “Materials”). The Company may also collect other data regarding your use of the Site, such as click-stream data, your IP address, access times and the referring website addresses (for additional information, see the section titled “Cookies” below). In addition, through your use of the Mobile Application we may collect geolocation data
1.3 Information Provided by Third Parties
1.3.1 As described in the section titled “Information Provided by You “above, as a part of the Services, you can voluntarily input in your user profile your account(s) or card number(s) associated with certain retailer loyalty programs or the user-name and password that you use to access retailer website and internet services, (collectively, your “Retailer Loyalty Account Information”). By providing your Retailer Loyalty Account Information to us as described in the preceding sentence, and by using the Services, you hereby agree to authorize us on your behalf and as your agent, to share your Retailer Loyalty Account Information with the applicable retailers and with our affiliates for the purpose of obtaining from such retailers, or have our affiliates obtain from such retailers and send to us, the following purchasing information: a history of your purchases at such retailer store per shopping trip, including the name and number of items purchased, UPC (unified product code), the date of each purchase, store location, retailer name, retailer address and total amount spent per shopping trip, and such other information as may be provided (collectively, your “Purchasing Information”). You grant us a limited power of attorney, and appoint us as your attorney-in-fact and agent, to obtain your Purchasing Information from such retailers or have our affiliates obtain your purchasing information from such retailers. The Purchasing Information that we receive, either directly from the retailers or through our affiliates, may identify you by name or address. YOU ACKNOWLEDGE AND AGREE THAT WHEN THE COMPANY IS ACCESSING AND RETRIEVING PURCHASE INFORMATION FROM THIRD PARTIES, THE COMPANY IS ACTING AS YOUR AGENT, AND NOT AS THE AGENT OF OR ON BEHALF OF THE THIRD PARTY THAT OPERATES THE THIRD PARTY RESOURCE. We cannot always foresee or anticipate technical or other difficulties which may result in failure to obtain data or loss of data, personalization settings or other service interruptions. We cannot assume responsibility for the timeliness, accuracy, deletion, non-delivery or failure to store any user data, communications or personalization settings. For example, when displayed through the Services, Account Information is only as fresh as the time shown, which reflects when the information is obtained from such sites. Such information may be more up-to-date when obtained directly from the relevant sites. You can refresh your Account Information through the Services, in the manner prescribed in the associated instructions. We use your Purchasing Information to create a raw score that is based on the health attributes of the items you purchased during each shopping trip (each, a “Score”). We then use the Score to award points and/or cash back savings in your rewards program account, and give you an overall shopping score average for collective shopping trips (the “Average Score”). To the extent applicable, we may share your employee/member ID, first and last name and your Purchasing Information like the date of each purchase, store location, retailer name, retailer address, count of items, amount of cash back savings, shopping trip score, monthly average score with the Employers, Client Partners or other Affiliated Partners, as applicable, to award points and/or cash back savings. We may also use your Score and your Average Score to create certain aggregated information that does not permit direct association with you and is not linked to any of your personally identifiable information. You can view each Score and your Average Score as well as remove specific items from the calculation of your Average Score at any time by logging into your rewards program account. We do not share Your Purchasing Information with any other unaffiliated third party.
2. Modifications and Changes
2.1 We provide an easy way via an online account profile for you to access, correct, update or remove Information that has previously been provided to us. You can review your Information and make any necessary changes at any time, by logging in to your user account. In addition, to the extent applicable, the Employers, Client Partners or other Affiliated Partners, as applicable, may provide updated Account Information for you from time to time. If you are unable to edit your Information by logging into your user account, please contact us for assistance.
3. Use and Disclosure of Information Collected on this Site and Mobile Application
3.1 We use your Information to facilitate the Services. This includes responding to inquiries or service requests, providing information about and marketing our products and the Services, resolving problems with your user account, such as access issues, to arrange for and deposit rewards in your bank account(to the extent applicable) and managing Site and Mobile Application access and use of the Services.
3.2 As part of the Services, some users will qualify to participate in reward programs by supplying account information for certain retailer loyalty programs. If you choose to participate, your Account Information will be used for purposes of calculating rewards and mailing or e-mailing coupons or pre-paid rewards cards to you.
3.3 When you upload Materials to the Site, we may, in our discretion, choose to publish or display those Materials (together with your name) on the Site and Mobile Application and in materials related to the Site and Mobile Application and the Services. Published Materials can be viewed by other users of the Site.
3.5 The Company will not sell, share or rent your Information to third parties who are not affiliates of the Company, except that certain aggregated information that does not permit direct association with you (not linked to any of your personally identifiable individual) may be used by the Company for any purpose, including other business purposes and may be shared with third parties. In addition, the Company may share your Information and Materials with entities with whom it has contracted to provide aspects of the Services or who otherwise perform functions on behalf of the Company to provide the Services, such as its Internet hosting provider. The Company may also use your Information to send you additional information on products and services offered by the Company or related information from third parties.
3.6 We reserve the right to disclose Information that we believe is appropriate to cooperate in investigations of fraud or other illegal or inappropriate activity or in response to a subpoena or other legal process. For example, this means that if we conduct a fraud investigation and conclude that one side has engaged in deceptive practices, we can give that person or entity’s contact information to victims who request it. If a subpoena seeks information about you, we’ll make reasonable business efforts to contact you before providing information to the party that requests it, but we cannot guarantee that we will be able to do so.
3.7 We may disclose information to your agent or legal representative (such as the holder of a power of attorney that you grant, or a guardian appointed for you).
3.8 In addition, if you opt for direct deposit of the rewards you earn as a part of our rewards program in your bank account, we will share certain personal information with your financial institution in order to arrange for the deposit.
3.9 As with any other business, it is possible that in the future we could merge with or be acquired by another company. If such an acquisition occurs, the successor company would have access to the information maintained by us, including customer account information, but would continue to be bound by this Policy unless and until it is amended.
4. Protection of your Information
4.1 We are committed to protecting the security of the personal information you provide to us via the Site. The Company has implemented reasonable technical and organizational measures designed to deter unauthorized access, destruction, use, modification, or disclosure of individually identifiable information. Regardless of the precautions taken by us or by you, no data transmitted over the Internet or any other public network can be guaranteed to be 100% secure. We cannot ensure or warrant the security of any information you transmit to us and you provide all individually identifiable information via the Site and Mobile Application at your own risk.
4.2 You are responsible for maintaining the security of your User Profile Information, including your password and for any and all activities that occur under your account. Do not share this information with anyone. We will never ask you to send your password or other sensitive information to us in an email, though we may ask you to enter this type of information on the Site. If you are sharing a computer with anyone you should always log out before leaving a site or service to protect access to your personal information from subsequent users. The security of your use of the Mobile Application relies on your protection of your mobile device. You may not share your instance of the Mobile Application with anyone.
4.3 Any email or other communication purporting to be from us requesting your password or asking you to provide sensitive account information via email, should be treated as unauthorized and suspicious and should be reported to us immediately by emailing firstname.lastname@example.org. If you believe someone else has obtained access to your password, please change it immediately by creating a new password on your log in page or on your personal profile page and report it immediately by emailing email@example.com
5. Choice of Opt-In and Opt-Out; NutriSavings Program, Surveys and Other Information Gathering Activities
5.2 You may choose to OPT-OUT of the NutriSavings program by inactivating your NutriSavings account by contacting our customer service via email or phone and requesting your account be made inactive.
5.3 You may “opt-in” to having your Information used for purpose of receiving marketing material from us or our affiliates.
5.4 If you no longer wish to receive our newsletter and promotional communications, you may opt-out of receiving them by following the instructions included in each communication. Please understand that if you choose not to receive promotional correspondence from us, we may still contact you in connection with your relationship, activities, transactions and communications with us.
5.5 From time to time, we may provide you the opportunity to participate in Company surveys and other information gathering activities to obtain information regarding the use of and possible changes to the Company’s Services or the Site and Mobile Application and the attractiveness of additional Company service features or new products or services. Participation in these surveys and activities is completely voluntary and you will usually be provided a choice to participate anonymously. Information obtained from such activities may be used by us to consider enhancements or improvements to the Services, for future product development or for other purposes pertaining to the Services or the Company’s business.

7. Cookies and Other Tracking Technologies
7.2 In addition to cookies, we use web beacons or clear gifs (which are small pieces of code placed on websites used to collect advertising metrics, such as counting page views, promotion views, or advertising responses), tags, scripts or similar technologies (collectively referred to as “Tracking Technologies”) to understand Site usage, help customize our content, offerings or advertisements on the Site, personalize your experience on the Site, analyze trends, and for other purposes related to our management and administration of the Site.
8. Do Not Track
8.1 Certain browsers have a “do not track” feature that allows you to tell websites or applications that you do not want to have your online activities tracked. Please consult the “Help” section of your browser for more information. At this time, we do not respond to browser “do not track” signals. Please know that certain areas and features of our Site may be affected by turning off Tracking Technologies and you should be aware that disabling cookies or similar devices might prevent you from accessing some of our content or experiencing certain features as designed.
9. Children Under 13
9.1 The Site and Mobile Application is not intended for children under 13 years of age and the Company does not knowingly collect personal information from children under 13 without the consent of a parent or guardian. We request that all visitors under 13 years of age to the Site and Mobile Application not disclose or provide any personally identifiable information. Upon notification that a child under 13 has provided us with personally identifiable information, we will delete the child’s personally identifiable information from our records.
